IS A MATRIMONIAL AGREEMENT GOOD FOR YOU?
A matrimonial agreement is a contract establishing a regime of separation of property or modifying or terminate the legal regime that is provided by law. Spouses or potential spouses may enter into matrimonial agreements before or during the marriage as to all matters that are not prohibited by public policy, but usually require a court’s approval. Otherwise, each spouse will own an undivided one-half interest in the community property. If a couple marries in Louisiana or moves to Louisiana, they become subject to Louisiana’s community property law automatically, unless they modify or opt out of the community property regime by entering into a matrimonial agreement, which can set forth different rules to govern their property. The way an asset is titled does not always control whether it is separate or community property either. The source of the funds used to purchase the asset has to be looked at and taken into consideration if there is no matrimonial agreement.
